A Federal High Court in Kano has issued an order for the eviction of reinstated Emir Muhammadu Sanusi II from the Gidan Rumfa Palace. The court also directed the police to ensure that all rights and privileges due to the 15th Emir of Kano, Aminu Bayero, are upheld.
This decision follows the recent deposition of Emir Bayero, a move facilitated by the passage and assent of the amended Kano Emirate Council bill by Governor Abba Kabir Yusuf.
Presiding Judge Justice S. A. Amobeda emphasized that the ex parte order was made in the interest of justice and maintaining peace in Kano. The court’s order includes:
- An interim injunction preventing any actions that could infringe on Emir Sanusi II’s rights until the originating motion is heard.
- A prohibition on denying Emir Sanusi II access to his official residence and palace at Kofar Kudu, along with all associated rights and privileges.
The case has been adjourned to June 4, 2024, for further hearing.
In a conflicting development, a state high court led by Justice Amina Adamu Aliyu granted an order halting the eviction of Emir Sanusi II. The state court’s order includes:
- An interim injunction against further harassment, intimidation, or invasion of Emir Sanusi II’s personal or official residence by the respondents or their agents.
- A prohibition on confiscating any symbols of the Emir’s authority, including the twin spear, the Royal Hat of Dabo, the ostrich-feathered shoes, the knife, and the sword.
- An order to maintain the status quo and restrain any actions interfering with Emir Sanusi II’s duties until the motion on notice dated May 28, 2024, is heard.
These conflicting court orders highlight the ongoing tension and potential for unrest in Kano State if the emirship tussle is not resolved.
