The Federal High Court sitting in Abuja on Monday dismissed a fresh application filed by Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), seeking release on bail pending the determination of the treasonable felony charge preferred against him by the Federal Government.
The dismissal occurred as Kanu presented reasons why he believes he cannot be tried in any court in the country. Addressing the court from the dock, Kanu denied allegations that he had previously jumped bail, asserting that he had only escaped an assassination attempt.
Kanu argued that the government violated international treaties by forcefully arresting him in Kenya and rendering him back to Nigeria to continue his trial. He maintained that his escape was a necessity for his safety and not an evasion of justice.
Trial Justice Binta Nyako, in her ruling, stated she was not inclined to grant bail to the defendant, citing Kanu’s previous bail jumping as a significant factor. Justice Nyako highlighted that Kanu’s sureties had approached the court to be discharged from the case after he fled, stating they were unaware of his whereabouts. Consequently, the court ordered the forfeiture of the N100 million each of the sureties had deposited as bail bonds.
Kanu’s legal team has continually argued that the circumstances of his departure from Nigeria were beyond his control, pointing to an alleged assassination attempt. The defense maintains that his rendition from Kenya was a breach of international law, rendering any subsequent trial unlawful.
Despite these arguments, the court remained firm in its decision to deny Kanu’s bail, underscoring the complexities surrounding his case and the serious nature of the charges against him. The prosecution has maintained that Kanu’s actions and the allegations against him constitute a severe threat to national security, justifying his continued detention and trial.
